Section 1 Preliminary
1.1 Title
1.1(1) This Rule is Land Transport Rule: Omnibus Amendment 2007.
1.1(2) This Rule amends the following Land Transport Rules:
- (a) Land Transport (Driver Licensing) Rule 1999;
- (b) Land Transport Rule: Heavy Vehicles 2004;
- (c) Land Transport Rule: Heavy-vehicle Brakes 2006;
- (d) Land Transport Rule: Passenger Service Vehicles 1999;
- (e) Land Transport (Road User) Rule 2004;
- (f) Land Transport Rule: Traffic Control Devices 2004;
- (g) Land Transport Rule: Tyres and Wheels 2001;
- (h) Land Transport Rule: Vehicle Dimensions and Mass 2002;
- (i) Land Transport Rule: Vehicle Lighting 2004;
- (j) Land Transport Rule: Vehicle Standards Compliance 2002.
1.2 Commencement
This Rule comes into force on [Date]1.
1Commencement dates for each amended Rule have not yet been determined. These may vary.
Section 2 Driver licensing
2.1 Amendments to Land Transport (Driver Licensing) Rule 1999
2.1(1) In this section, “principal Rule” means Land Transport (Driver Licensing) Rule 1999.
2.1(2) Clauses 5(3) and 5(4) of the principal Rule are amended by inserting the words “, 16(1)(c)(i) and 16(1)(d)(i)” after the words “16(1)(b)”.
2.1(3) Clause 16(1)(c) of the principal Rule is amended by inserting the following subparagraph:
- “(iii) must not carry another person on the moped or in a sidecar attached to the moped;”
2.1(4) Clause 18(1) of the principal Rule is amended by substituting the following for paragraph (b):
- (b) In the case of a Class 6R licence, the holder must not—
- “(i) drive between the hours of 10 pm and 5 am; or
- “(ii) drive a motorcycle that has a total piston displacement exceeding 250 cm3; or
- “(iii) carry another person on a moped or motorcycle or in a sidecar attached to a moped or motorcycle.”
2.1(5) Clause 26(3) of the principal Rule is amended by substituting the following for the definition of “security officer”:
- “security officer means a person appointed or engaged under section 17 of the Corrections Act 2004.”
2.1(6) Clause 50 of the principal Rule is amended by inserting the word “tractor” before the word “or”.
2.1(7) Clause 67A(5) of the principal Rule is amended by substituting the words “16(1)(b), (c) and (d)” for the words “16(1)(b) and (c)”.
2.1(8) Subclause 88(1A) of the principal Rule is amended by substituting the words “Subclause (1)(a)” for the words “Subclause (1)”.
2.1(9) Clause 89(2)(b) of the principal Rule is amended by inserting the words “Unless clause 89A(3) applies,” before the word “pass”.
2.1(10) Clause 89(2)(c) of the principal Rule is amended by substituting the word “89A(4)” for the word “89A(1)(b)”.
2.1(11) Clause 89(2) of the principal Rule is amended by substituting the following for paragraph (d):
- “(d) produce his or her overseas driver licence or permit as specified in clause 88(1)(a) and, if the overseas driver licence or permit is not in English, either an accurate English translation of the overseas driver licence or permit, or a valid and current international driving permit; and”.
2.1(12) Clause 89(3)(b) of the principal Rule is amended by inserting the words “Clause 89A(3) applies to that person or” before the words “he or she”.
2.1(13) The principal Rule is amended by substituting the following for clause 89A:
“89A Requirements not applying to overseas drivers
“(1) This clause applies to a person who applies for a New Zealand driver licence under clause 89.
“(2) A person to whom this clause applies is not required to comply with the minimum time requirements prescribed in the tables to clauses 15, 17, and 19.
“(3) A person to whom this clause applies is not required to sit the appropriate theory test required by clause 89(2)(b) if—
- “(a) the appropriate theory test is in respect of a Class 1 or Class 6 licence; and
- “(b) that person has held a valid overseas driver licence or permit issued in a country—
- “(i) specified in Schedule 7A; or
- “(ii) notified by the Director in the Gazette in accordance with subclause (5).
“(4) A person to whom this clause applies is not required to sit the appropriate practical driving test required by clause 89(2)(c) if that person has, for at least 2 years, held a valid overseas driver licence or permit issued in a country—
- “(a) specified in Schedule 8; or
- “(b) notified by the Director in the Gazette in accordance with subclause (6).
“(5) For the purpose of subclause (3)(b)(ii), the Director may, by notice in the Gazette, approve any country not specified in Schedule 7A.
“(6) For the purpose of subclause (4)(b), the Director may, by notice in the Gazette, approve any country not specified in Schedule 8.”
2.1(14) The principal Rule is amended by inserting the following Schedule:

2.1(15) Schedule 8 of the principal Rule is amended by substituting the word “89A(4)” for the word “89A(1)(b)”.
Section 3 Heavy vehicles
3.1 Amendments to Land Transport Rule: Heavy Vehicles 2004
3.1(1) In this section, “principal Rule” means Land Transport Rule: Heavy Vehicles 2004.
3.1(2) Subclause 1.2(4) of the principal Rule is amended by inserting:
- (a) the word “4.7(1)(c),” before the word “4.7(2)”; and
- (b) the word “4.8(1)(a)(iii),” before the word “4.8(2)”.
3.1(3) Section 2 of the principal Rule is amended by inserting the following clause:
“2.2 Vehicle standards include alternatives
References in an approved standard to New Zealand Standard: 4711, Qualification tests for metal-arc welders shall be deemed to include, as an alternative, Australian/New Zealand Standard: 1554, Structural steel welding.”
3.1(4) The principal Rule is amended by omitting the words “New Zealand Standard 5446:1987, Code of Practice for Heavy Motor Vehicle Towing Connections: Drawbar Trailers” and substituting the words [NZS 5446:2007 Heavy Vehicle Towing Connections–Drawbar Trailers]2 in the following provisions:
- (a) 4.3(2), 4.3(3);
- (b) 4.4(1), 4.4(2)(a), 4.4(2)(b), 4.4(3), 4.4(4)(b), 4.4(4)(c);
- (c) 4.5(1), 4.5(2)(a), 4.5(2)(b), 4.5(5);
- (d) 4.6(3).
3.1(5) Clause 4.7 of the principal Rule is amended by:
- (a) substituting the following for subclause 4.7(1):
- “4.7(1) A vehicle that is constructed to tow a semi-trailer must be fitted with:
- “(a) a 50 mm diameter fifth wheel that complies with 4.7(2); or
- “(b) a 90 mm diameter fifth wheel that complies with 4.7(3); or
- “(c) if the vehicle is certified for use in a dedicated combination, a tow ball that complies with [NZS 5446: 2007, Heavy Vehicle Towing Connections–Drawbar Trailers]”.3”;
- “4.7(1) A vehicle that is constructed to tow a semi-trailer must be fitted with:
- (b) inserting the following subclause:
- “4.7(6) A fifth wheel that is not permanently fitted may not be used to tow a semi-trailer.”
3.1(6) Paragraph 4.8(1)(a) of the principal Rule is amended by inserting the following paragraph:
- “; or
- “(iii) if the vehicle is certified for use in a dedicated combination, a socket that complies with [NZS 5446: 2007, Heavy Vehicle Towing Connections–Drawbar Trailers]4”
3.1(7) Clause 5.4 of the principal Rule is amended by substituting the following for subclause 5.4(1):
“5.4(1) If a vehicle has a curtain-sided body that is constructed to secure a load on a vehicle, each curtain and curtain anchorage system must:
- “(a) have a manufacturer’s load rating appropriate for all conditions of loading and operation of the vehicle; and
- “(b) be clearly marked, with the manufacturer’s load rating in kilograms per metre, in a position on the vehicle that is readily accessible for inspection purposes.”
3.1(8) The definition of “chassis rating”, in Part 2 of the principal Rule, is amended by inserting in paragraph (b) the words “(if available)” after the words “axle-set masses”.
3.1(9) Part 2 of the principal Rule is amended by inserting the following definition in the appropriate place:
- “dedicated combination means a combination of vehicles certified for use in combination where both vehicles are affixed with a plate clearly and indelibly marked with the VIN or chassis number of the other vehicle.”

Section 4 Heavy-vehicle brakes
4.1 Amendments to Land Transport Rule: Heavy-vehicle Brakes 2006
4.1(1) In this section, “principal Rule” means Land Transport Rule: Heavy-vehicle Brakes 2006.
4.1(2) Paragraph 2.3(11)(b) of the principal Rule is amended by substituting the word “18%” for the words “1 in 5”.
4.1(3) Subclause 7.4(1) of the principal Rule is amended by substituting the words “TC or TD” for the words “TB or TC”.
Section 5 Passenger service vehicles
5.1 Amendments to Land Transport Rule: Passenger Service Vehicles 1999
5.1(1) In this section, “principal Rule” means Land Transport Rule: Passenger Service Vehicles 1999.
5.1(2) Clause 1.6 of the principal Rule is amended by substituting the following for paragraph (g):
“(g) motor vehicles registered under the Amusement Devices Regulations 1978 that are either:
- “(i) used in adventure tourism; or
- “(ii) trailers designed, constructed and permitted to be drawn at a maximum speed of 50 km/h or less.”
5.1(3) Clause 8.2(1)(b) of the principal Rule is amended by substituting the words “AS/NZS 3856.2:1998” for the words “AS 3856.2:1998”.
Section 6 Road user
6.1 Amendments to Land Transport (Road User) Rule 2004
6.1(1) In this section, “principal Rule” means Land Transport (Road User) Rule 2004.
6.1(2) Clause 1.6 of the principal Rule is amended by inserting the following definition in the appropriate place:
“approved disabled person's parking permit means a disabled person's parking permit approved by the Director”.
6.1(3) Subclause 2.3(1) of the principal Rule is amended by substituting the following for paragraph (f):
“(f) a special vehicle lane reserved for a specific class or classes of vehicle unless:
- “(i) the vehicle is one of the class or classes of vehicle for which the lane is reserved; or
- “(ii) the vehicle is an emergency vehicle being used in an emergency.”
6.1(4) Clause 6.4 of the principal Rule is amended by inserting the following subclause:
“(1A) Without limiting subclause (1), a driver or person in charge of a vehicle must not stop, stand or park the vehicle in any parking area reserved for disabled persons unless:
- “(a) the driver or any passenger is disabled; and
- “(b) an approved disabled person's parking permit is displayed in the vehicle.”
6.1(5) The principal Rule is amended by substituting the following for clause 6.6:
“6.6 Parking in a special vehicle lane
A driver or person in charge of a vehicle must not stop, stand or park the vehicle in any special vehicle lane unless:
“(a) the vehicle belongs to a class of vehicle for which use of the lane is reserved, and stopping, standing or parking of the vehicle is permitted at that place by signs or markings; or
“(b) the vehicle is an emergency vehicle that is being used in an emergency and is operating a red beacon or red and blue beacons.”
6.1(6) Clause 7.18 of the principal Rule is amended by inserting the following subclause:
“(4A) A driver must not, during the hours of darkness, tow a trailer unless the trailer's position lamp or lamps (if fitted) are displayed.”
Section 7 Traffic control devices
7.1 Amendments to Land Transport Rule: Traffic Control Devices 2004
7.1(1) In this section, “principal Rule” means Land Transport Rule: Traffic Control Devices 2004.
7.1(2) Paragraph 8.2(10)(b) of the principal Rule is amended by substituting the words “400 mm” for the words “300 mm”.
7.1(3) Schedule 1 of the principal Rule is amended:
- (a) by inserting the following paragraph after the third paragraph (which begins “• The letter ‘F’…”):
“• The letter ‘f’ after a colour indicates that the colour may be fluorescent.”
- (b) by substituting the following for the legend fields in item R2-8:

Section 8 Tyres and wheels
8.1 Amendments to Land Transport Rule: Tyres and Wheels 2001
8.1(1) In this section, “principal Rule” means Land Transport Rule: Tyres and Wheels 2001.
8.1(2) Subclause 2.3(2) of the principal Rule is amended by substituting the words “on groundspreaders, dedicated groundsprayers or agricultural tractors” for the words “on groundspreaders or dedicated groundsprayers”.
8.1(3) Part 2 of the principal Rule is amended by inserting the following definition in the appropriate place:
“Agricultural means connected directly with the operation or management of a farm.”
Section 9 Vehicle dimensions and mass
9.1 Amendments to Land Transport Rule: Vehicle Dimensions and Mass 2002
9.1(1) In this section, “principal Rule” means Land Transport Rule: Vehicle Dimensions and Mass 2002.
9.1(2) Subclause 4.1(4) of the principal Rule is amended by inserting the following paragraph:
“(j) the wheels, on a rear steering single large-tyred axle, that extend not more than 25 mm from either side of the vehicle.”
9.1(3) Clause 4.2 of the principal Rule is amended by substituting for paragraph 4.2(11) the following:
“4.2(11) If a semi-trailer has a quad-axle set the two rearmost or the foremost and rearmost axles must be steering axles capable of turning in both directions through an angle of at least 15 degrees; except that the foremost of the two steering axles may be locked in the straight-ahead position at a speed of 30 km/h or more.”
9.1(4) Paragraph 6.2(4)(b) of the principal Rule is amended by substituting the words “a minimum nominal bore of 300 mm” for the words “a minimum diameter of 400 mm”.
9.1(5) Table 6.1 of the principal Rule is amended by substituting the following for the row relating to “Category 3(a)” motor vehicles:

9.1(6) The definition of “twin-steer axle set”, in Part 2 of the principal Rule, is amended by substituting the words “an axle set of two axles” for the words “a tandem axle set”.
Section 10 Vehicle lighting
10.1 Amendments to Land Transport Rule: Vehicle Lighting 2004
10.1(1) In this section, “principal Rule” means Land Transport Rule: Vehicle Lighting 2004.
10.1(2) Subclause 2.1(7) of the principal Rule is amended by inserting the words “Except as provided in 2.1(7A), a forward-facing lamp” for the words “A forward-facing lamp”.
10.1(3) Clause 2.1 of the principal Rule is amended by inserting the following subclause:
“2.1(7A) A Class NC vehicle first registered in New Zealand before 27 February 2005 may be fitted with a forward-facing position or cosmetic lamp that is not maintained in accordance with subclause 2.1(7) provided the lamp does not emit light when turned on.”
10.1(4) Clause 4.3 of the principal Rule is amended by substituting the following for subclause 4.3(11):
“4.3(11) In addition to the stop lamps specified in subclause 4.3(5), 4.3(6) or 4.3(7), a motor vehicle of Class ME or an emergency vehicle may be fitted with:
- “(a) one additional pair of stop lamps at the rear of the vehicle if the additional pair is positioned as close as practicable to the top of the bodywork; or
- “(b) two additional pairs of stop lamps at the rear of the vehicle, if:
- “(i) one additional pair of lamps is fitted at a height of no more than 2.1 m from the ground; and
- “(ii) the second additional pair of lamps is fitted as close as practicable to the top of the bodywork.”
10.1(5) Clause 6.3 of the principal Rule is amended by substituting for subclause 6.3(7) the following:
“6.3(7) In addition to the direction-indicator lamps specified in 6.3(3) or 6.3(4), a motor vehicle of Class ME or emergency vehicle may be fitted with:
- “(a) one additional pair of direction-indicator lamps at the rear of the vehicle if the additional pair is positioned as close as practicable to the top of the bodywork; or
- “(b) two additional pairs of direction-indicator lamps at the rear of the vehicle, if:
- “(i) one additional pair of lamps is fitted at a height of no more than 2.1m from the ground; and
- (ii) the second additional pair of lamps is fitted as close as practicable to the top of the bodywork.”
10.1(6) Subclause 6.3(9) of the principal Rule is amended by substituting the words “Except as provided in subclause 6.3(7), the lamps” for the words “The lamps”.
10.1(7) Clause 7.4 of the principal Rule is amended by substituting the following for subclause 7.4(8):
“7.4(8) In addition to the position lamps specified in 7.4(4) or 7.4(5), a motor vehicle of Class ME or an emergency vehicle may be fitted with:
- “(a) one additional pair of position lamps at the rear of the vehicle if the additional pair is positioned as close as practicable to the top of the bodywork; or
- “(b) two additional pairs of position lamps at the rear of the vehicle, if:
- “(i) one additional pair of lamps is fitted at a height of no more than 2.1 m from the ground; and
- “(ii) the second additional pair of lamps is fitted as close as practicable to the top of the bodywork.”
10.1(8) Subclause 7.6(3) of the principal Rule is amended by:
- (a) substituting the word “twelve” for the word “six”;
- (b) substituting the word “six” for the word “four”.
10.1(9) Clause 7.6 of the principal Rule is amended by substituting the following for subclause 7.6(4):
“7.6(4) Subject to 7.6(2) and 7.6(3), a motor vehicle of Class NB that exceeds 1.8 m in overall width may be fitted with up to six forward-facing end-outline marker lamps.
“7.6(5) A vehicle, other than one specified in 7.6(2), 7.6(3) or 7.6(4) must not be fitted with any end-outline marker lamps.”
10.1(10) Clause 10.9 is amended by substituting the words “cosmetic lamps” for the words “lamps that are not otherwise specified in this Rule”.
10.1(11) Part 2 of the principal Rule is amended by inserting the following definition in the appropriate place:
- “cosmetic lamp means a lamp that is not a headlamp, stop lamp, direction-indicator lamp, position lamp, rear registration plate illumination lamp, rear reflector, fog lamp, daytime running lamp, cornering lamp, reversing lamp, reflective material, interior lamp, work lamp, flashing or revolving beacon or illuminated vehicle-mounted sign.”
10.1(12) Schedule 2 of the principal Rule is amended by substituting the words “Safety Regulations for Road Vehicles, Chapter III (Japan)” for the words “Safety Regulations for Road Vehicles, Chapter II (Japan)”.
